These Terms and Conditions set out the basis on which Rubbish Removal Hammersmith provides rubbish removal and waste collection services. By making a booking, confirming an order, or allowing our operatives to carry out any services at your property, you agree to be bound by these Terms and Conditions.
These terms apply to domestic and commercial customers within our service area. Please read them carefully before placing a booking. If you do not agree with any part of these terms, you should not use our services.
In these Terms and Conditions, the following expressions have the meanings set out below:
1.1 Company, we, us or our means Rubbish Removal Hammersmith, the waste removal service provider.
1.2 Customer, you or your means the individual or business placing a booking or using our services.
1.3 Services means rubbish removal, waste collection, clearance, loading, transportation and lawful disposal services provided by us.
1.4 Booking means a request by you for us to provide services, whether made by telephone, email, online form, or any other method accepted by us.
1.5 Waste means any items, materials or substances that you ask us to remove, including household waste, commercial waste and bulky items, but excluding any prohibited items described in these terms.
2.1 We provide rubbish removal and waste collection services including, but not limited to, household clearances, commercial clearances, garden waste removal, white goods removal, and general waste collection.
2.2 Our services typically include loading the waste onto our vehicle, transporting it away from the property, and disposing of it at an authorised facility in accordance with applicable waste regulations.
2.3 We reserve the right to refuse to collect any waste that we reasonably consider unsafe, prohibited by law, improperly described, or beyond the agreed volume or weight limits.
2.4 Any illustrative descriptions, estimates or photographs used in our advertising or communications are for general guidance only and do not form part of these Terms and Conditions.
3.1 Bookings may be made by telephone, email, or through our online enquiry or booking channels where available.
3.2 When making a booking, you will be asked to provide details including your name, contact information, service address, access information, type and approximate amount of waste, and preferred date and time for collection.
3.3 We may provide an estimate based on the information you supply. This estimate is not binding and is subject to confirmation by our operative upon arrival and inspection of the waste.
3.4 Your booking is not accepted by us until we confirm it, which may be done verbally, by email, text message or other written confirmation.
3.5 The customer is responsible for ensuring that all information provided during the booking process is accurate and complete. Any inaccuracies may result in additional charges, delays, or cancellation of the service.
4.1 You must ensure safe, reasonable and timely access to the property and to the waste to be collected. This includes providing any necessary access codes, entry instructions, parking permissions and accurate directions.
4.2 If suitable parking is not available or is restricted, you must inform us in advance. Any parking charges, fines or penalties incurred in relation to carrying out the services may be added to your invoice.
4.3 You are responsible for ensuring that the waste intended for removal is clearly identified and separated from any items that you wish to keep.
4.4 We will use reasonable care and skill in performing the services. However, our operatives are not obliged to undertake any task that, in their reasonable opinion, poses a health and safety risk or could cause damage to property.
5.1 Prices are generally based on the volume and type of waste, weight, access conditions and time required to complete the service.
5.2 Any price given prior to inspection is an estimate only. The final price will be confirmed on site once our operative has inspected the waste and assessed the work required.
5.3 If, upon arrival, it becomes clear that the volume, type or location of the waste differs significantly from the description provided at the time of booking, we may adjust the price or decline the service.
5.4 If you choose not to proceed after we have arrived on site and provided a final price in line with our pricing structure, we reserve the right to charge a call-out or attendance fee to cover our costs.
6.1 Unless otherwise agreed in writing, payment is due immediately upon completion of the service.
6.2 We may accept payment by cash, bank transfer, debit card, credit card or other methods that we notify you of at the time of booking or service.
6.3 For commercial customers, we may, at our discretion, offer account terms. Where account terms are agreed, payment must be made within the agreed period from the date of invoice.
6.4 If payment is not received by the due date, we reserve the right to charge interest on the overdue amount at the applicable statutory rate and to recover any reasonable costs we incur in seeking to recover the debt.
6.5 All prices quoted are exclusive of any applicable taxes unless explicitly stated otherwise.
7.1 You may cancel or amend your booking by contacting us as soon as possible using the contact details provided at the time of booking.
7.2 If you cancel more than 24 hours before the scheduled collection time, no cancellation fee will normally be charged.
7.3 If you cancel less than 24 hours before the scheduled collection time, or if we are unable to carry out the service due to your failure to provide access or accurate information, we may charge a reasonable cancellation or call-out fee.
7.4 We reserve the right to cancel or reschedule a booking at any time due to circumstances beyond our control, including but not limited to vehicle breakdown, adverse weather conditions, staff illness or safety concerns. In such cases, we will seek to provide as much notice as reasonably possible and offer an alternative date or a refund of any advance payment.
8.1 You confirm that you are the owner of the waste or have the full authority and consent of the owner to request its removal and disposal.
8.2 You must ensure that the waste is not contaminated with hazardous or prohibited items and that it is reasonably accessible for our operatives.
8.3 You agree to provide any information we reasonably request relating to the composition, origin or handling requirements of the waste.
8.4 You must not conceal any hazardous materials or sharp objects within bags or containers. Items of this nature must be disclosed and appropriately packaged for safe handling where we have agreed to take them.
9.1 We do not accept certain types of waste, including but not limited to asbestos, medical waste, clinical waste, toxic chemicals, flammable liquids, gas cylinders that are not empty or safe, explosives, radioactive materials and any other waste classified as hazardous under applicable legislation unless specifically agreed in advance and arranged through appropriate licensed channels.
9.2 If hazardous or prohibited waste is identified on site that was not disclosed at the time of booking, we reserve the right to refuse removal and to charge for any wasted journey or additional handling required.
9.3 If you have any doubt about whether a particular item can be collected, you must raise this with us before the service date so that we can confirm whether it is acceptable or advise on alternative arrangements.
10.1 We will handle, transport and dispose of waste in accordance with applicable UK waste management laws and regulations.
10.2 We will only use licensed waste transfer stations, recycling facilities and disposal sites and will take reasonable steps to maximise recycling and recovery where practicable.
10.3 Where required by law, we will produce or retain appropriate waste transfer documentation and ensure that the description of the waste is accurate based on the information provided by you.
10.4 Once the waste has been collected by us, legal ownership of the waste passes to us, subject to any obligations imposed by waste legislation.
11.1 We will exercise reasonable care and skill in providing the services. Our liability to you is limited as set out in this section.
11.2 We will not be liable for any damage to property caused by pre-existing defects, poor construction, structural weakness, or where our operatives were required to follow your express instructions against their advice.
11.3 You must notify us of any damage or loss that you believe was caused by our services as soon as reasonably practicable and, in any event, within 48 hours of the service being carried out. We may request evidence, photographs or access to inspect the alleged damage.
11.4 Our total liability to you arising out of or in connection with the services, whether in contract, tort, negligence or otherwise, shall not exceed the total price paid or payable by you for the specific service giving rise to the claim, except where such limitation is not permitted by law.
11.5 We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law.
11.6 We will not be liable for any indirect, consequential, or economic loss, including but not limited to loss of profits, loss of business, loss of opportunity, or loss of data arising out of or in connection with the services.
12.1 We will not be responsible for any failure or delay in performing our obligations where such failure or delay results from events or circumstances beyond our reasonable control, including but not limited to extreme weather, traffic disruption, accidents, breakdowns, strikes, road closures, or the actions of third parties.
12.2 If such an event occurs, we will take reasonable steps to notify you and to minimise the impact on our services, including offering to reschedule where appropriate.
13.1 We maintain appropriate insurance cover in relation to our rubbish removal and waste collection activities, including public liability insurance, in line with industry practice.
13.2 Our insurance coverage is subject to the terms, conditions and exclusions of the relevant policy or policies. Copies of insurance details are available on request.
14.1 We collect and process personal information such as your name, contact details and service address for the purpose of managing bookings, providing services, and issuing invoices.
14.2 We will handle your personal data in accordance with applicable data protection laws and only retain it for as long as is necessary for the purposes for which it was collected or as required by law.
14.3 We may use your contact details to communicate with you about your booking, to request feedback, or to inform you about similar services that we offer. You can ask us to stop sending non-essential communications at any time.
15.1 If you are dissatisfied with any aspect of our services, please contact us as soon as possible so we can attempt to resolve the issue.
15.2 We will investigate complaints fairly and promptly and, where appropriate, may offer a remedy such as a partial refund, re-performance of the service, or another reasonable solution, having regard to the circumstances.
16.1 We may amend these Terms and Conditions from time to time. Any changes will take effect from the date they are published or otherwise communicated to you.
16.2 The version of the Terms and Conditions that applies to your booking will be the version in force at the time you made the booking, unless a change is required by law or regulatory authority, in which case it may apply to bookings already in place.
17.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the services, shall be governed by and construed in accordance with the laws of England and Wales.
17.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the services.
18.1 If any provision of these Terms and Conditions is found by a court or other authority to be invalid, illegal or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.
18.2 No failure or delay by us in exercising any right or remedy under these Terms and Conditions shall operate as a waiver of that right or remedy, and no single or partial exercise shall preclude any further exercise of that or any other right or remedy.
18.3 You may not assign or transfer any of your rights or obligations under these Terms and Conditions without our prior written consent. We may assign or transfer our rights and obligations to another organisation, provided that this does not adversely affect your rights under these Terms and Conditions.
18.4 These Terms and Conditions constitute the entire agreement between you and us in relation to the provision of our rubbish removal and waste collection services and supersede any prior agreements, understandings or arrangements, whether written or oral, relating to their subject matter.
